The named defendants were the governor, the superintendent of public instruction, the state treasurer, the president pro tempore of the Senate, the Speaker of the House of Representatives, and members of the State Board for Elementary and Secondary Education. The plaintiffs alleged that the funding for local schools was “inadequate and inequitable” and in violation of Kentucky’s constitutional provision requiring an “efficient system of common schools throughout the state” (Chellgren, 1985).

The state’s contribution to education funding makes up the difference between a district’s adjusted base guarantee and its local contribution. In this way state support varies according to school district wealth. Rich districts receive less state funding and poor districts more, which equalizes the total support for education. School districts that wish to spend more than their adjusted base guarantee have two options. Under a program known as Tier 1 they can increase their allotted amount by as much as 15 percent through additional local taxes.
